The upcoming AI Act from the European Union (EU) will change how we use AI in marketing. For those of us in small and medium-sized businesses (SMEs), it’s important to know what’s coming and how to get ready.

What is the AI Act?

The AI Act is a set of rules to make sure AI is used safely and ethically. It’s all about protecting consumers and making things transparent. The Act will roll out from 2024 to 2031, giving businesses time to adapt.

Here’s what it aims to do:

  • Make sure AI tools are safe to use.
  • Ensure people understand how AI works.
  • Encourage the development of safe and useful AI technologies.

Our Challenges

I hear you: Even without any new law, we, marketing managers in SMEs, have our own set of challenges. Do you relate with these situations?

How The Act Affects Marketing

The AI Act will change how we use AI in marketing in several ways. We’ll need to make sure we handle data ethically and transparently. Our customer service will need to be adapted to meet new rules, ensuring they are fair and clear. AI-generated content must be unbiased and fair. And when it comes to targeting and personalization, we’ll need to balance advanced techniques with consumer privacy.

Not following the AI Act can result in big fines and legal issues – and that in turn will damage your company’s reputation and disrupt your operations. You risk losing your competitive edge.

What You Can Do Now

Here’s how to get started:

  1. Make sure everyone understands the basics of the AI Act.
  2. Assign someone as your “AI Manager”, to ajust your processes for compliance AND to stay updated on AI technology and legal developments to ensure your business remains compliant and ahead of the curve.
  3. Review your current AI tools to see if they meet the new rules.
  4. Outline steps to comply with the AI Act, including timelines and who’s responsible.
  5. Keep learning about AI regulations and best practices.

Timeline

The AI Act’s timeline helps us gradually adjust:

  • 2024: Initial guidelines released.
  • 2025-2027: Focus on high-risk AI systems.
  • 2028-2030: Broader compliance measures kick in.
  • 2031: Full compliance expected.

The AI Act is coming, and it will change the marketing world – especially for us in SMEs. Let’s work now to understand these new rules and get ready: Our AI-driven marketing strategies must be compliant AND great for our customers and our businesses. We need time to adjust, so we should start now.
